The petitioner being in custody in connection with Sambalpur Town P.S. Case No.162 of 2021 corresponding to T.R. Case No.13 of 2021 pending in the court of the learned Sessions Judge-cum-Judge (Special Court), Sambalpur running for the alleged commission of offence under sections 21(b)/29 of the N.D.P.S. Act has filed this application under section 439, Cr.P.C. for her release on bail.

Heard learned counsel for the petitioner and learned counsel for the State.

Taking into account the submissions made and on going through the materials on records as those stand against the Petitioner as also the quantity of contraband ganja said to have

been seized and also the report that the Petitioner has no such prior involvement in commission of similar offence; further keeping in view the surrounding circumstances including the period of detention of the Petitioner in custody; it is directed that the petitioner be released on bail in the aforesaid case with such terms and conditions as deemed just and proper by the court in seisin of the case with further conditions that:-

(i) he will appear in person on each date of posting of the case before the court in seisin of the case till conclusion of trial;

(ii) will report before the Sambalpur Town P.S. on every Monday in between 10 A.M. to 2 P.M. for a period of one year; and

¶23

(iii) will not indulge himself in commission of similar activity.

Violation of any of the above condition(s) shall entail cancellation of bail.

The BLAPL is accordingly disposed of.
