This matter is taken up through Hybrid Arrangement (Video Conferencing/Physical Mode).
Heard learned counsel for the petitioner and the learned counsel for the State.
This is an application under section 439 of Cr.P.C. in connection with Purighat P.S. Case No.234 of 2020 corresponding to G.R. Case No.1331 of 2020 pending in the Court of learned S.D.J.M.(Sadar), Cuttack for alleged commission of offence under section 392/34 of the Indian Penal Code.
The prayer for bail of the petitioner has been rejected by the learned 1st Additional Sessions Judge, Cuttack by order dated 20.05.2021.
It appears that when this bail application was filed by

the petitioner, another bail application of the petitioner in BLAPL No.1648 of 2021 was subjudiced before this Court and the said bail application was rejected as per order dated 13.07.2021. In the present bail application, in the cause title, certificate has been given that the matter was never before this Court in the present form at the instance of the petitioner.
Obviously, this is not a correct statement, which has been furnished in the cause title in the present bail application.
Accordingly, the bail application of the petitioner stands rejected.
