Learned counsel for the petitioner submits that the petitioner is in judicial custody since 24.11.2020 and he has been charge sheeted under sections under sections 147, 148, 324, 302, 120-B/149 of the Indian Penal Code and as per the eye witnesses account, six to seven persons participated in the assault of the deceased Salbum Enka. So far as the petitioner is concerned, it is stated by the eye witness Kanha Rao Salbum that the petitioner and other co-accused persons caught hold of the deceased when Salbum Muta assaulted the deceased by means of an axe, as a result of which the deceased sustained bleeding injuries and died. Learned counsel further stated that the said witness also stated that Salbum Dula and Sariam Desa also assaulted the deceased. Learned counsel further submitted that the petitioner was not present at the scene of occurrence as he was deputed as a Guard for guarding the E.V.M. in the office of the Collector, Malkangiri and he has been falsely entangled in the case. Some documents have been filed in support of such plea and he submitted that the bail application of the petitioner may be favourably considered.
