This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

The Petitioner, by filing this application, has prayed for modification of the condition imposed on him by order dated 22.06.2021 passed in BLAPL No.2910 of 2021 as to his appearance before the Inspector-in-Charge of Badachana Police Station on every Monday in between 10.00 am to 2.00 pm for a period of one year.

Learned counsel for the Petitioner submits that abiding the said condition, the Petitioner since his release from custody, has been appearing before the Inspector-in-Charge of the concerned P.S, as directed. It is submitted that the place where the Petitioner is residing is at a distance of 70 kms. from the Police Station and under the circumstance, when the

Petitioner is appearing before the Court in seisin of the case on each date of posting of the same, now his appearance before the Inspector-in-Charge of the concerned P.S. on every Monday is standing too harsh and it is affecting his livelihood and thereby he and his family are facing hardship. He, therefore, prays for waiver of the condition as to appearance of the Petitioner before the Inspector-in-Charge of Badachana Police Station on every Monday in between 10.00 am to 2.00 pm for the rest period.

Learned counsel for the State submits that looking at the nature of accusations, this Court had rightly imposed that condition and, therefore, there stands no need for its waiver.

Considering the submissions made and on going through the averments taken in the petition, the condition, as above, stands modified to the extent that now onward, the Petitioner would appear before the Inspector-in-Charge of Badachana Police Station as and when so required.

The I.A. is accordingly disposed of.
