Heard Mr. K.C. Rath, learned counsel for the petitioners and Mr. G.R. Mohapatra, learned Additional Standing Counsel through Video Conferencing Mode.

The petitioner has filed this application under Section 439, Cr.P.C. praying for bail in connection with Purighat P.S. Case No.234 of 2020 corresponding to G.R. Case NO.1331 of 2020 now pending before the learned S.D.J.M.(S), Cuttack for alleged commission of offences under Sections 392/34, I.P.C.

The bail application of the petitioner has been rejected by the learned 3^rd Additional Sessions Judge, Cuttack on 5.2.2021 inter alia on ground of criminal antecedents of the petitioner.

Mr. Rath submits that the petitioner is in custody since 6.1.2021 and charge sheet has already been submitted under Sections 392/34, I.P.C. which is triable by the Magistrate. He further submits that in the meantime, co-accused person, namely, Prasanta Sethi @ Papu Sethi has been allowed to be released on bail by this Court vide order dated 10.3.2021 passed in BLAPL No.1234 of 2021. Accordingly, he prays that this petition be allowed.

Considering the submission made and the fact that charge sheet has already been filed and coaccused person has already been released on bail, this Court allows the prayer for bail and directs

that the petitioner be released on bail in the aforesaid case on furnishing a bail bond of Rs.50,000/- (Rupees fifty thousand) with two solvent sureties each for the like amount to the satisfaction of the learned court in seisin over the matter with the further condition that the petitioner shall appear before the I.I.C., Purighat Police Station once in every alternate Sunday in between 10.00 a.m. to 4.00 p.m. for a period of six months from the date of release, shall not indulge in any criminal activities and shall appear before the learned trial court on each date to which the case would be posted for trial.

The BLAPL is accordingly disposed of.
