This is an application under section 439 of Cr.P.C. in connection with G. Udayagiri P.S. Case No. 80 of 2020 corresponding to C.T. Case No. 234 of 2020 pending in the file of learned J.M.F.C., G.Udayagiri for alleged commission of offence under section 379 of the Indian Penal Code.
The prayer for bail of the petitioners was rejected by the learned Addl. Sessions Judge, Baliguda vide order dated 23.12.2020.
Considering the submissions made by the learned counsel for the petitioners that the petitioners were taken on remand in this case on 25.11.2020, the offence is triable by Magistrate, charge sheet has already been submitted and similarly situated co-accused has already been released on bail in BLAPL No. 1229 of 2021, copy of which is filed and taken on record and on hearing the learned counsel for the State, I am inclined to release the petitioners on bail.
Let the petitioners be released on bail in the aforesaid case on furnishing a bail bond of Rs.50,000/- (rupees fifty
thousand) each with two local solvent sureties each for the like amount to the satisfaction of the learned Court in seisin over the matter with further conditions as the learned Court may deem just and proper.
The BLAPL is accordingly disposed of. Issue urgent certified copy as per Rules.
