The matter is taken up by video conferencing mode. Heard learned counsel for the Petitioner and learned counsel for the State.
Considering the submissions and on going through the nature of accusations; further keeping in view the surrounding circumstances of the case as also concerning the petitioners and in the absence of any other impediment, it is directed that in the event the Petitioner surrenders before the court in seisin of the case in connection with Bonth P.S. Case No.140 of 2020 corresponding to G.R. Case No.2042 of 2020 on the file of learned S.D.J.M., Bhadrak, within three weeks hence and moves for his release on bail, he shall be released on bail on such terms and conditions as would be deemed just and proper by the said court with further conditions that he will not indulge himself in commission of similar offences; and appear in person before the court in seisin of the case on each date of posting of the case.
The ABLAPL is accordingly disposed of.
As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court’s website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed, vide Court’s Notice No.4587, dated 25th March, 2020 as modified by Court’s Notice No.4798 dated 15th April, 2021.
