The aforesaid I.A. has been filed by the Inspector-inCharge, Pipili Police Station to recall the order dated 26.10.2021 passed by this Court imposing cost of Rs.10,000/on him for non-production of the Case Diary in spite of the communication to him.

Considering the averments made in the I.A., so also the submission advanced on behalf of the State, the dereliction appears to this Court to be bonafide one and, as such, the cost imposed on the I.I.C., Pipili Police Station vide order dated 26.10.2021 stands waived out with a caution that she should not repeat such dereliction in future.

4. Accordingly, the I.A. stands disposed of.

Heard the learned counsel for the petitioners and the learned counsel for the State on the question of pre-arrest bail.

The Petitioners apprehending their arrest in Pipili P.S. Case No.337 of 2021, registered for alleged commission of offences punishable under Sections 420 and 379/34 of IPC, have filed this petition for their release on pre-arrest bail.

Considering the facts and submission made, especially the nature and gravity of accusation, character of incriminating materials appearing against the Petitioners, circumstances in which they have been indicted, seriousness of the offences alleged, this Court is not inclined to release the Petitioners on pre-arrest bail, more so when they have criminal antecedents of committing similar type of offences.

Accordingly, the prayer for pre-arrest bail of the petitioners stands rejected and the ABLAPL stands disposed of being dismissed.

A copy of this order be communicated to the Superintendent of Police concerned forthwith.
