08.09.2020 In the wake of the pandemic Covid-19, the case is taken up through V.C.

Heard learned counsel for the petitioners and learned counsel for the opposite parties.

In this writ petition, the petitioners have prayed to issue writ in the nature of mandamus directing the Opposite Party Nos.1 & 2 to pay the Revised Scale of Pay as per the 6^th Pay Commission Report w.e.f. 01.01.2006 and release the arrear salary w.e.f. 01.01.2006 to 31.12.2010 in their favour.

Learned counsel for the petitioners submits that the case of the petitioners is covered by decision of this Court in the case of Mayadhar Pradhan & others –Vrs- State of Orissa & others passed in W.P.(C) No.8608 of 2010, disposed of on 26.03.2019. Therefore, the Court may dispose of this writ petition with

direction to the Opposite Party Nos.1 & 2 to pay the Revised Scale of Pay as per the 6^th Pay Commission Report w.e.f. 01.01.2006 and release the arrear salary w.e.f. 01.01.2006 to 31.12.2010 in favour of the petitioners within a stipulated period.

Considering the aforesaid submissions, the writ petition is disposed of with a direction to Opposite Parties to consider the prayer of the petitioners for payment of the Revised Scale of Pay as per the 6^th Pay Commission Report w.e.f. 01.01.2006 within four months of receipt of copy of this order, if the case of the petitioner is covered by the decision of this Court rendered in the case of Mayadhar Pradhan & others (supra) which stated to have not been challenged and benefit have been extended to the petitioners therein pursuant to the said order.

With the aforesaid order, this writ petition is disposed of.

Due to difficulties faced by the parties in getting the certified copies of this order and in view of the Court’s Notice No.4587 dated 25.03.2020, if a printout of the copy of this order from the website of the High Court is

produced by the party or their counsel before opposite parties concerned, the same be treated at par with the certified copy. However, the copy so produced must be certified by the petitioners or their counsel to be the true copy of the order passed.
