Heard Mr. P. Das, learned counsel for the petitioner and Mr. Panda, learned Additional Government Advocate for the State-opposite parties.

The petitioner in this writ petition prays for a direction to the opposite party no.3-Tahasildar, Nischintakoili for demarcation of the schedule land of the petitioner.

Learned counsel for the petitioner submits that the R.O.R. stands recorded in the name of the petitioner and there is no legal impediment for demarcation of the land. Since the boundary tenants are creating disturbance, the petitioner has filed an application before the Tahasildar, Nischintakoiliopposite party no.3 for demarcation of the land but the same has not yet been disposed of. He, therefore, prays for disposal of the same in accordance with law.

for the State, however, submits that the petitioner has to file an application before the Tahasildar, Nischintakoili-opposite party no.3 for demarcation of the case land in proper format along with requisite fee & relevant documents for consideration.

Taking into consideration the submissions of learned counsel for the parties, this writ petition is disposed of with a direction that in the event the petitioner files an application for demarcation of land, i.e. Plot No.462/2720 under Khata No.843/241 to an extent of Ac.0.114 decimals and Plot No.462 under Khata No.843/242 to an extent of Ac.0.113 decimals of Mouza-Badakhiri under Nischintakoili Tahasil in the district of Cuttack before the Tahasildar, Nischintakoili-opposite party no.3 in proper format along with requisite fee & relevant documents within a period of four weeks hence, the same shall be considered and disposed of in accordance with law by the Tahasildar, Nischintakoili-opposite party no.3 as expeditiously as possible preferably within a period of eight weeks from the date of filing of such application giving notice to the petitioner as well as the boundary tenants following due procedure of law.
