17.08.2020 Due to outbreak of COVID-19, this matter is taken up through Video Conferencing.

Heard Mr.Partha Sarathi Das, learned counsel for the petitioner and Mr.D.K.Mohanty, learned Additional Government Advocate appearing for the State opposite parties.

Petitioner, in this petition, has prayed for a direction for registering the complaint petition (Annexure-1) intended to be filed before the learned SDJM, Khurda.

It is submitted by Mr.Das, learned counsel for the petitioner that office of learned SDJM, Khurda is not receiving the complaint petition of the petitioner as at Annexure-1 on the plea that during pandemic of COVID-19 only urgent matters are being taken up. He therefore, prays for the aforesaid relief.

Mr.Mohanty, learned Additional Government Advocate, on the other hand, submits that there is no prohibition for receiving and registering a complaint petition intended to be filed by anybody before the competent authority. Petitioner may take steps for filing the complaint petition (Annexure-1) before learned SDJM, Khurda. In the event of filing of such complaint, learned SDJM, Khurda may be directed to receive and register the same.

Taking into consideration the innocuous nature of prayer made and the submissions of learned counsel for the parties, this Court disposes of the CRLMP with a direction that in the event the petitioner files the complaint petition as at Annexure-1 under the provisions of Criminal Procedure Code, learned SDJM, Khurda shall do well to receive and register the same.

6.1 Registry is directed to communicate this order to learned District and Sessions Judge, Khurda to do the needful.
