This matter is taken up through Video conferencing. Heard the submission of Sri Acharya, learned counsel for the petitioner and learned Standing Counsel appearing for the School & Mass Education Department.
Sri Acharya, learned counsel for the petitioner submitted that petitioner has an allegation that his case stands in similar footing to that of the persons benefitted vide Annexure-2 series by virtue of the order of the Tribunal. Considering this submission of learned counsel for the petitioner, this Court finds there is no issue in keeping this matter pending except directing the Director of Elementary Education and Block Education Officer, opposite party nos.2 and 3 respectively to consider the applicability of the decision of the Tribunal indicated in Annexure-2 series to the case of the petitioner and pass appropriate order by examining the demand of the petitioner involved in the writ petition treating the writ petition as a representation but, however, without entering into delay aspect if any.
Decision as appropriate be taken by the opposite party nos.2 and 3 however keeping in view the development through Annexure-2 series as well as the judgment in the disposed of Original Applications indicated therein in Annexure-2 series by completing the entire exercise within a period of two months from the date of communication of this order by the petitioner along with copy of the writ petition.
The writ petition stands disposed of with the observation and direction made hereinabove.
