Upon hearing the learned counsel for the petitioner and learned counsel for the State and on going through the averments taken in the petition as also the documents annexed thereto, further keeping in view the prayer as has been advanced; this Court is not inclined to entertain this writ application. Accordingly, the writ application stands dismissed.
It is however, open to the petitioner to approach the Sarpanch, Alipur Grama Panchayat-opposite party no.4 in initiating appropriate action as against the so called intruder in respect of said shop room in the market complex at Alipur Hat in accordance with law.
Issue urgent certified copy as per rules.
