Heard learned counsel for the parties by video conferencing mode.

The petitioner, by means of this writ application, seeks to quash advertisement no. 3250 dated 14.07.2020 issued for grant of long term lease of minor minerals by the office of the Tahasildar, Jajpur in Annexure-1, so far as it relates to item no.11, i.e., Sairat Case No.7/2019-20 of Baitarani River Balighat Unit-2.

Mr. B.N. Panda, learned counsel for the petitioner contended that the advertisement under Annexure-1, so far as column-11 is concerned, has been issued without any survey or without taking into consideration the representation of Barahanath villagers and, as such, in deviation of the Odisha Minor Mineral Concession Rules, 2016.

Mr. P.P. Mohanty, learned Addl. Government Advocate appearing for the State opposite parties contended that the petitioner has already moved the Collector, Jajpur vide Annexure-2 series making certain grievance by way of representation, which is still pending for consideration, and there will be no impediment on the part of the authority to consider the same.

Having heard learned counsel for the parties, but

without expressing any opinion on the merits of the case, the writ application stands disposed of directing the Collector, Jajpur to consider the grievance made by way of the representation in Annexure-2 series and dispose of the same in accordance with law by passing a reasoned and speaking order as expeditiously as possible, preferably within a period of six weeks from the date of communication of this order.

With the above observation and direction, the writ application stands disposed of.

As Lock-down period is continuing for COVID-19, learned counsel for the parties may utilize the soft copy of this order available in the High Court’s official website or print out thereof at par with certified copies in the manner prescribed, vide Court’s Notice No.4587 dated 25.03.2020.
