The lands under sabik khata no.30 corresponding to Hal khata no.202, plot no.2007 area-Ac.0.44 decimal and plot no.2008 area-Ac.0.26 decimals in mouzaBhedabahal in the district of Sundargarh were acquired by the Government of Odisha for public purpose under the provisions of Land Acquisition Act, which has been notified at Sl. No.9 of the notice indicating the name of the land looser as Mukteswar Naik, Dhaneswar Naik son of Karamu Naik only. After going through the notification, since the names of the petitioners were not reflected in the notice, even though they are the owners of the acquired land, they filed objection before the Land Acquisition Officer, Sundargarh ventilating that they have right, title and interest over the acquired land and thereby they are entitled for compensation amount and accordingly, made a prayer for reference of the dispute to the competent civil court for adjudication of the entitlement of the parties, which was refused on 09.06.2020. As such, the Land Acquisition Officer ignored the claim and contention of the petitioners without appreciating the same in proper perspective. The certified copy supplied to the petitioners on 01.07.2020 in Land Acquisition Case No.41 of 2018 would show that no decision has been taken on 09.06.2020. But, the compensation amount for the acquired land measuring Ac.0.70 decimals has been assessed to the tune of Rs.44,03,751/- in favour of opposite parties no.4 to 21. Hence this application.
