13.08.2020 In the wake of the pandemic Covid-19, the case is taken up through V.C.

Heard learned counsel for the petitioner and the learned counsel for the State.

The grievance of the petitioner in this writ application is that over his Stitiban land i.e. Plot No.541, Khata No.135/18 in Mouza-Bilagadia under Ranpur Tahasil in the district of Nayagarh, Opposite Party No.3 is going to construct a public road without acquisition of the land and paying the compensation for acquisition. The same being contrary to law, he has filed a representation before the Collector-Opposite Party No.2 under Annexure3 to consider his grievance in this regard in the light of

the law laid down in the case of Bhagaban Behera and

others Vrs. Central Institute of Fresh Water

Acquaculture and 3 others, reported in 2009(II) OLR 148/108(2009) CLT 2006 but, no action on the same having been taken, he has come in this writ application against such inaction.

Considering the limited grievance of the petitioner and the submissions made, the writ petition is disposed of with direction to Opposite Party No.2 (Collector-CumDistrict Magistrate, Nayagarh) to look into the matter and take a decision on Annexure-3 in the manner known to law within a period of three months of receipt of this order and intimate the decision thereof to the petitioner.

It is made clear that the order of this Court should not be construed as an expression of any opinion on the merit of such representation in either way as the Court has not examined the merit of such representation in any manner but only directed to take a decision on the same.
