02. 01.05.2020 Heard learned counsel for the parties.

Petitioner has prayed for the following

relief:

• “(i) To quash the impugned order issued vide order No.5721/FSCW dtd-12.03.2020 under Annexure-5 in so far as enclosing the name of the petitioner’s FPS bearing FPS Code No.1911P001 under Ward No.1 of Balugaon NAC is concerned.

• (ii) To direct the Opposite Party No.1 to exclude the name of the petitioners FPS from the impugned list prepared under Annexure-5 considering the fact that the petitioner has achieved 79.99% of BioMetric AADHAR Authenticated Transaction through E-PoS as per the report submitted by the concerned field officers, i.e. Opposite Party No.4 under Annexure-4.

• (iii) To direct the Opposite Parties more particularly the Opposite Party No.3 to renew the PDS license of the petitioner under Wad No.1 of the Balugaon NAC for the year 2020-21 within a time framed by this Hon’ble Court.

• (iv) To direct the Opposite Parties to allow the petitioner to continue as PDS Retailer of Ward No.1 of Balugaon NAC in the district of Khordha for distribution of all the essential Commodities to the Ration Card Holders/beneficiaries.

And to pass such other order/orders. Direction/directions as deemed fit and proper in the facts and circumstances of the case.
