09.01.2020 Heard Mr. U.K. Samal, learned counsel for the petitioner and Mr. A. Mishra, learned counsel for opposite party no.1.

The petitioner has filed this application with the prayer to set aside order dated 26.12.2017 passed by the learned Judge, Family Court, Bhadrak in Cr.P No. 1229 of 2016 granting interim maintenance to the opposite parties.

Mr. U.K. Samal, learned counsel for the petitioner, in course of hearing, contended that the petitioner does not want to press the prayer made in this application and, on the other hand, Cr.P. No. 1229 of 2017 seeking for interim maintenance and also divorce proceeding bearing CP No. 258 of 2017, which are pending before the learned Judge, Family Court, Bhadrak be targeted to be disposed of within a stipulated period.

Mr. A. Mishra, learned counsel for opposite party no.1 contended that so far as interim maintenance case is concerned, the same may be targeted to be disposed of, but so far as divorce case is concerned he has no instructions in that regard.

Considering the submissions made by learned counsel for the parties and after going through the record, since learned counsel for the petitioner has made a very innocuous prayer before this Court that he does not want to press the prayer made in this application and instead of that Cr.P. No. 1229 of 2017 and CP No. 258 of 2017, which are pending before the learned Judge, Family Court, Bhadrak be targeted to be disposed of, this Court disposes of this application directing the learned Judge, Family Court, Bhadrak to dispose

of the aforesaid two proceedings in accordance with law by affording opportunity of hearing to all the parties within a period of six months from the date of receipt of this order.

Needless to say, the parties shall cooperate with the hearing of the matter on day today basis and, as such, shall not ask for any unnecessary adjournment.

The CRLMP is accordingly disposed of.
