Heard Mr. S. Swain, learned counsel for the petitioner and Mr. B. Mohanty, learned Standing Counsel for School and Mass Education Department.
Mr. B. Mohanty, learned Standing Counsel for School and Mass Education Department submits that the order of this Court has been complied with and payment has been made.
Mr. S. Swain, learned counsel for the petitioner disputes above contention and states that the petitioner is entitled payment from the year 2011 but he has been paid from subsequent date.
Therefore, if the petitioner disputes with regard to the date of eligibility of receipt of payment, he has got separate cause of action.
The contempt application is accordingly dropped. However, liberty is granted to the petitioner to pursue his remedy before the appropriate forum, if cause of action still survives.
