Basu Munda Vs State of Odisha

The petitioner being in custody in G.R. Case No.596 of 2019, arising out of Joda P.S. Case No.169 of 2019, pending in the court of learned J.M.F.C., Barbil has filed this petition for his release on bail. The offence alleged against the petitioner is punishable under Section 302 of the I.P.C.

The case of the prosecution is that when the deceased had been to his maternal uncle’s house, he was assaulted by the present petitioner, as a result of which, he sustained injury and while he was being shifted to

hospital two days thereafter, on the way he succumbed to the injuries sustained.

On consideration of the facts and submissions made, especially the fact that petitioner is a tribal, circumstances in which the offence stated to have been committed and there is no material to suggest that the petitioner’s release shall have an adverse impact on trial and/or he shall abscond, if released on bail, I am of the view that the petitioner in this case deserves to be released on bail.

Hence, the petitioner be released on bail in the aforesaid case by the Court in seisin over the matter on such terms and conditions as it would deem just and proper.

Accordingly, the BLAPL stands disposed of being allowed.
