The petitioner, namely, Samir Ranjan Das is implicated in Balianta P.S. Case No.204 of 2019, corresponding to G.R. Case No.949 of 2019 of the Court of learned JMFC(O), Bhubaneswar for the offence U/ss.420/ 406/ 294/ 323/ 506/34 of the Indian Penal Code.
The complaint bearing No. 2440 of 2019 was sent under Section 156(3) of the Cr.P.C. resulting registration of Balianta P.S.Case No. 204 of 2019 under Sections 420/406/294/323/506/34 of the I.P.C. and the allegation against this accused-petitioner is that he has not paid Rs.1,00,000/-(One lakh) as against the loan of Rs.5,00,000/-(Five lakhs)
Learned Addl. Standing Counsel for the State submits that accused-petitioner is involved in similar nature of case in G.R. Case No. 2207 of 2012 of the court of learned SDJM, Rourkela. The petitioner is in custody since 6.01.2020.
Having heard learned counsel for the parties, considering the nature of accusation and period of detention, i.e. from 6.01.2020, I am inclined to grant bail to the petitioner. Hence ordered.
Let the petitioner Samir Ranjan Das be released on bail by the learned court in seisin over the matter in the above noted case on such terms and conditions as deemed just and proper.
The BLAPL is accordingly disposed of.
