This matter is taken up through Video Conferencing due to Lockdown in the wake of Pandemic COVID-19.

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

This is an application under Section 439, Cr.P.C. for grant of bail to the petitioner in connection with Chandaka P.S. Case No.142 of 2019 corresponding to G.R. Case No.899 of 2019 pending in the court of the learned J.M.F.C.(O), Bhubaneswar for alleged commission of offence under Sections 419/420/467/468/471/34 of the I.P.C.

The petitioner moved an application for bail before the court of the learned 3^rd Additional Sessions Judge, Bhubaneswar which was rejected on 18.08.2020.

Considering the submissions made by the learned counsel for the petitioner that the petitioner is in judicial custody since 02.06.2020 and charge-sheet has already been submitted under Sections 419/420/467/468/471/34 of the I.P.C. coupled with the fact that co-accused, namely, Prasanna Kumar Misra has already been enlarged on bail vide order dated 29.09.2020 passed by this Court and the offences are triable by the Magistrate and on hearing the learned counsel for the State, I am inclined to release the petitioner on bail.
