This is an application under Section 439 Cr.P.C. for grant of bail to the petitioner in connection with Jharsuguda G.R. P.S. Case No. 102 of 2018, corresponding to C.T. Case No. 12 of 2019, pending in the court of learned Sessions Judge, Jharsuguda for alleged commission of offences under Sections 498(A)/302 of I.P.C..
Considering the circumstances of the case and the statement of the eye witness Puja Mahananda, I am not inclined to release the petitioner on bail.
Accordingly, the prayer for bail of the petitioner is rejected.
The BLAPL stands dismissed accordingly.
However, as prayed by the learned counsel for the petitioner he is at liberty to renew his prayer for bail after examination of the eye witness Puja Mahananda in course of trial and the learned court is directed to expedite the trial.
