Heard learned counsel for the petitioner as well as learned Counsel for the State through Video Conferencing.
This is an application under Section 439 Cr.P.C. for grant of bail to the petitioner in connection with Bada Bazar P.S. Case No. 14 of 2020 corresponding to G.R. Case No. 135 of 2020 pending in the court of learned S.D.J.M., Berhampur for alleged offence under Section 120-B/395/412/414 of I.P.C..
It is submitted on behalf of the petitioner that the petitioner is inside custody since 05.02.2020 and though there is no direct allegations against the petitioner but the allegations are about criminal conspiracy. It is also submitted that the present petitioner has no criminal antecedent.
After hearing the learned counsel for the State and considering the nature of materials brought against this petitioner and the period of detention of the petitioner inside custody, it is directed to release the petitioner on bail in the aforesaid case on such terms and conditions to be fixed by the learned court below in seisin over the matter including the condition that the petitioner shall appear before the IIC, Bada Bazar police station as and when directed and he shall not be involved in any other offence while on bail.
The BLAPL is accordingly disposed of.
