Heard learned counsel for the petitioner and learned counsel for the State.
This is an application under Section 439 Cr.P.C. for grant of bail to the petitioner Sania Singh in connection with G.R. Case No.636 of 2018 arising out of Jagatpur P.S. Case No.203 of 2018 pending in the court of learned J.M.F.C., Salipur for alleged commission of offence under Sections 302/201/34 of Indian Penal Code.
It is submitted on behalf of petitioner that he is inside custody since 01.08.2018 and in the meantime investigation has been completed. It is further submitted that this petitioner was the salesman of the liquor shop where the deceased had gone to purchase liquor and as he abused the petitioner in obscene words demanding liquor without paying the cost, there was an exchange of hot words between the parties and in that event the petitioner, out of anger, assaulted him and there was no intention on the part of the petitioner to kill the deceased.
After hearing learned State counsel and considering the statement of eye witnesses as well as circumstances of the case, it is directed to release the petitioner on bail on such terms and conditions to be fixed by the learned counsel in seisin over the matter.
The BLAPL is accordingly disposed of.
