This is an application under Section-439 Cr. P.C
for bail.
Considered the materials placed by learned counsels for the parties.
5.5 Kg. Ganga is stated to have been seized from the conscious possession of the petitioner, which is admittedly more than the small quantity and less than the commercial quantity.
Regard being had to the facts and submissions, factum of permanent residence of the petitioner and stage of proceedings, it is directed that the petitioner shall be released on bail by the learned Special Judge-cum-Addl. Sessions Judge, Khallikote in 2(a) C.C. Case No.06 of 2020(N) arising out of P.R. Case No.45 of 2019 on such terms and conditions as deemed just and proper.
The Bail Application is accordingly disposed of.
