The matter is taken up through Video Conferencing. Heard learned counsel for the petitioner and learned counsel for the State.
This is an application under section 439 of Cr.P.C. for grant of bail to the petitioner in connection with Jeypore Town P.S. Case No. 293 of 2019 corresponding to T.R. Case No.71 of 2019 pending in the Court of learned Sessions Judge -cumSpecial Judge, Koraput-Jeypore for alleged commission of offences under sections 20(b) (ii) (C)/ 25 of the N.D.P.S. Act.
The prayer for bail of the petitioner has been rejected by the learned learned Sessions Judge -cum- Special Judge, Koraput-Jeypore by order dated 04.12.2019.
Learned counsel for the petitioner submitted that the bail application of the petitioner was rejected by the learned trial Court when the investigation was under progress and now he has instruction that charge sheet has already been submitted and therefore, he wants to move a petition for bail before the learned trial Court again for reconsideration.
In view of such submission, the bail application is disposed of as withdrawn.
