ABLAPL No.3907 of 2020
The petitioners are apprehending arrest for the alleged commission of offences punishable under Sections 341/ 294/ 323/ 325/ 457/ 354/ 506/ 34 of the I.P.C. in G.R. Case No.125 of 2020, of the court of the learned J.M.F.C., Nimapara, arising out of Nimapara P.S. Case No.47 of 2020.
No criminal antecedent is reported against the petitioners. Moreover, the petitioners are permanent residents of village- Sudhabarimula, P.S.- Nimapara, in the district of Puri. Hence, there is no chance of their abscondance from the process of justice. There is also no allegation on behalf of the prosecution that the petitioners shall tamper the prosecution evidence, if they are released on bail.
Keeping in view the aforesaid consideration, the application for anticipatory bail of the petitioners is allowed. On the event of their arrest, the petitioners shall be released on bail by the Arresting Officer on such terms and conditions as deemed just and proper by him/her in the aforesaid case.
