12.05.2020 Heard learned counsel for the petitioners and the learned Additional Standing Counsel for the State.

The petitioners are apprehending arrest for the alleged commission of offences punishable under Sections 143/ 341/ 283/ 294/ 506/ 149 of the I.P.C. read with Section 7 of the Criminal Law (Amendment) Act, 2013 in G.R. Case No.1784 of 2018, of the court of the learned S.D.J.M., Bhadrak, arising out of Bhandaripokhari P.S. Case No.183 of 2018.

No criminal antecedent is reported against the petitioners. Moreover, the petitioner nos.1 and 2 are permanent residents of villages Baghamara and Karanjigunupur respectively, P.S.- Dhamnagar, in the district of Bhadrak and petitioner nos.3 to 12 are permanent residents of different villages of P.S. Bhandaripokhari, in the district of Bhadrak. Hence, there is no chance of their abscondance from the process of justice. There is also no allegation on behalf of the prosecution that the petitioners shall tamper the prosecution evidence, if they are released on bail.

Keeping in view the aforesaid consideration, the application for anticipatory bail of the petitioners is allowed. On the event of their arrest, the petitioners shall be released on bail by the Arresting Officer on such terms and conditions as deemed just and proper by him/her in the aforesaid case.
