04 01.06.2020 Heard Dinesh Kumar Mohanty, learned counsel for the petitioners and Mr. Karunakar Nayak, learned Additional Standing Counsel.

The petitioners have prayed for anticipatory bail under section 438 Cr.P.C. apprehending arrest for the alleged commission of offences under sections 454 and 380 of the Indian Penal Code in G.R. Case No. 588 of 2020 of the Court of the learned S.D.J.M., Puri arising out of Chandanpur P.S.Case No.46 of 2020.

It is submitted by the learned counsel for the petitioners that there is long standing civil dispute between the parties and there is also business rivalry between the parties, who are neighbours. Learned Additional Standing Counsel has no serious objection if the application for anticipatory bail is allowed in favour of the petitioners and further submits on instruction that there is no criminal antecedent against the petitioners.

Moreover, the petitioners are permanent residents of village Chandanpur under Chandanpur P.S. in the district of Puri, there is no reasonable apprehension of their abscondance from justice. There is no allegation on behalf of the prosecution that the petitioners will tamper with the prosecution evidence if they are released on bail.

In that view of the matter, the ABLAPL is allowed.

Let the petitioners surrender before the learned S.D.J.M., Puri within twenty one working days hence in connection with the aforesaid case and apply for bail. On such event they shall be released on bail on such terms and

conditions as deemed just and proper by the learned magistrate.

The petitioners shall not be arrested by the I.O. or any Police Officer on his own accord or any warrant issued by the learned S.D.J.M., Puri till expiry of twentyone working days.
