By way of this writ petition, the petitioner has challenged the illegal action of opposite parties in debarring him to participate in the future tender for a period of one year, imposition of penalty @ 10% of service charges and termination of contract for the work “Engagement of Contractual Labourers as per agreement dated 01.04.2017 for providing manpower for carrying out maintenance work in Clusters-1 and 4 of Cuttack SSA.
This Court vide order dated 22.05.2019 while issuing notice to the opposite parties directed that pendency of the writ petition shall not be a bar for the General Manager, Bharat Sanchar Nigam Limited, opposite party no.1, to dispose of the representation of the petitioner under Annexure-8.
Learned counsel for the opposite parties states that the representation of the petitioner under Annexure-8 has already been disposed of by opposite party no.1 in terms of the order passed by this Court on 22.05.2019.
In that view of the matter and in view of the fact that the representation of the petitioner under Annexure-8 has been disposed of, it will be open for the petitioner to challenge the decision of opposite party no. 1 as per law.
Accordingly, this writ petition stands disposed of.
Urgent certified copy of this order be granted on proper application.
