Heard Shri S. Nayak, learned counsel for the petitioner and Shri B. Behera, learned Additional Standing Counsel for the State-opposite parties.
This matter involves change of the condition so far it relates to the condition no.3 in the matter of release of vehicle in question.
Shri S. Nayak, learned counsel for the petitioner submits that for the constraint faced by the petitioner in providing bank gurantee and instead of bank gurantee involving the amount involved therein in condition no.3, the petitioner is ready to give the property security, as such, prayed for suitable modification of condition no.3.
Considering this simple prayer and finding that the petitioner is ready for giving the property security for release of the vehicle in question instead of bank gurantee, this Court interfering in the condition no.3 substitutes the same by permitting the petitioner to give the property security in view of the amount involved in condition no.3. It would be open to the petitioner to produce the copy of order of this Court along with property security before the competent authority to get release of the vehicle, in such event, the authority shall do well in releasing the vehicle in question in accordance with law.
The I.A. stands disposed of with the above modification.
