Brief facts of the case are that on 8.6.1981, the petitioner was initially appointed as a Sevak by the District Welfare Officer, Rayagada. The petitioner acquired B.Ed. qualification in 1987. The petitioner was transferred to Budaguda High School situated under Rayagada Welfare District. Thereafter, he was transferred to Bijayanagar Primary Sevashang School as a Sevak. A provisional gradation list was published on 3.2.1997 in respect of Sevaks and Assistant Teachers in which objections were called for. The petitioner submitted his objection before the District Welfare Officer, Rayagada as his name finds place at Sl. No. 187 in the gradation list where Sevaks junior to the petitioner were placed above and requested the District Welfare Officer, Rayagada to consider his case for promotion to the post of Trained Graduate Teacher on the basis of his seniority. Although juniors to the petitioner have been promoted to the post of Trained Graduate Teacher on 05.08.1997, his case has not been considered for promotion. Being aggrieved, the petitioner filed O.A. No. 2911(C) of 1997 before the Odisha Administrative Tribunal, Cuttack Bench, Cuttack. Learned Tribunal considering the materials available on record vide order dated 12.10.2004 allowed the Original Application but no financial benefit for the intervening period has been granted to him as he has not worked during that period as a Trained Graduate Teacher. Hence, this writ petition.
