03. 18.07.2019 Heard learned counsel for the petitioner.
The petitioner has filed this application seeking direction to the opposite parties to take immediate steps to disburse differential arrear dues from 31.07.1978 to 31.12.2005, i.e., from the date of possessing the requisite common qualification to the date of receiving the revised scale as fixed in the T.G. scale in terms of resolution dated 18.02.2008 vide Annexure-4 of the School and Mass Education Department by modifying the order in Annexure-5.
In course of hearing, learned counsel for the petitioner states that highlighting the grievance, the petitioner has made appeal to opposite party no.1 vide Annexure-6, but no decision has yet been taken. Therefore, the same may be considered in the light of the judgments of this Court in Smt. Dipti Roy v. State of Orissa, 2004 (II) OLR 718 and Bijay Ketan Khatua v. State of Orissa , 2015 (II) OLR 452.
Considering the limited grievance of the petitioner, without expressing any opinion on the merits of the case, this Court disposes of the writ petition directing opposite party no.1 to take a decision on the appeal filed by the petitioner vide Annexure-6 in the light of the judgments in Dipti Roy and Bijay Ketan Khatua (supra) and pass appropriate order within a period of three months from the date of production of certified copy this order by affording opportunity of hearing to the petitioner.
