In course of hearing, Mr.L.Mishra, learned Advocate for the petitioners submits that the petitioners have filed the civil suit. He further submits that the suit may be decided by the learned trial court without being fettered by order dated 22.11.2016 passed by the Commissioner, Land Records and Settlement in R.P.Case No.786 of 2005.
Since the competent civil court is in seisin over the matter, this Court has not expressed any opinion on merits of the case. The learned trial court shall decide the case without being influenced by the impugned order.
The petition is disposed of.
