Heard Mr. J. Pattnaik, learned Senior Counsel appearing along with Mr. B. Mohanty, learned counsel for the petitioner and Mr. R. Sahoo, learned counsel for opposite party no.2.

This application has been filed by opposite party no.2-Orissa State Beverage Corporation Ltd. seeking for modification of order dated 13.08.2019 passed by this Court in W.P.(C) No.19541 of 2018 (analogous to this matter) by which direction was given to allow the petitioner to continue in his service till he attains the age of 60 years as per the order dated 22.06.2019 passed by the Registrar, Co-operative Societies, Odisha and consequential decision taken by the Odisha State Beverages Corporation Limited.

The order dated 13.08.2019 has been passed in agreement by the parties. But, now an application has been filed saying that the petitioner has come from Orissa State Co-operative Oil Seeds Growers Federation Ltd.(Oil Odisha) which is another co-operative society and unless the said co-operative society extended the benefit of superannuation of age from 58 to 60 years, the petitioner is not entitled to get such benefit. This is an after thought. Therefore, this Court is not inclined to entertain this Interlocutory Application. However, the matter should be sorted by the opposite parties and the petitioner should not be harassed. More so, the Registrar, Co-

operative Societies passed order on 22.06.2019 extending the benefit of retirement age from 58 to 60 years to all the employees of Co-operative societies of the State which includes Orissa State Co-operative Oil Seeds Growers Federation Ltd.(Oil Odisha). Accordingly, opposite party-Odisha State Beverage Corporation Ltd. has extended the benefit to the petitioner and the said benefit to be extended to the petitioner as due and admissible to him forthwith without causing any hindrance.

Accordingly, this Court is not inclined to modify the order dated 13.08.2019.
