Petitioners in this writ petition challenge the action of opposite party No.3-Tahasildar, Cuttack Sdaar in not disposing of the Mutation Case No.580 of 2011 and pray for a direction to said opposite party No.3 to proceed with the Mutation Case.
On perusal of record, it appears that vide order dated 15.03.2001, the Tahasildar Sadar, Cuttack kept the proceedings of Mutation Case Nos.580 and 581 of 2001 in abeyance awaiting finalization of OJC No.112 of 2001.
Mr.Rout, learned Additional Standing Counsel for the State submits that the Mutation Cases were initiated pursuant to the order passed in RP Nos.8065 and 8066 of 2000. Assailing the same OJC No.112 of 2001 was filed.
Thus, I find no infirmity in the order of the Tahasildar, Sadar, Cuttack in directing to keep the proceeding in abeyance till finalization of the aforesaid writ petition. Accordingly, the writ petition stands disposed of.
However, the petitioner is at liberty to move for early disposal of OJC No.112 of 2001 pending before this Court.
