The Postal colony road abutting the link road with a turning to the right side of the link road give passage for use by the staff of Hindustan Postal Colony. In between postal colony, the only private land of the petitioner is situated, which is abutting the aforesaid postal colony road used by the staffs. The petitioner wants permission from the Postal Department to use the said road for ingress and egress from his plot for the limited purpose of approval of building plan by the CDA. In such situation, when the only private land of the petitioner is surrounded by the quarters of the Postal Department, the options available to the Postal Department is either to give permission to the petitioner to use their road or to acquire land of the petitioner giving him the present market rate.

The second option may be far-fetched in view of the cost involved and in view of the fact that this is the only private land of the petitioner.

In such view of the fact, the Postal Department should acceded to the prayer of the petitioner to give him written permission to use the postal colony road for access to his land, so that he can get approval from the CDA. Otherwise also the petitioner is

now using that road for the said purpose. So, grant of written permission is only a formality.

Accordingly, the Writ Petition is disposed of directing the appropriate authorities of the Postal Department, especially Opp. Party no.2, to give written permission to the petitioner to use the postal colony road in question subject to the condition that the petitioner shall abide by the rules and regulations of the postal colony within which premises, his private land is situated.
