Heard Mr. S.K. Jee, learned counsel for the petitioner and Mr. P.K. Panda, learned Standing Counsel for School and Mass Education Department.
The petitioner has filed this writ petition seeking for direction to the opposite parties to grant pension in terms of the Orissa (Aided Educational Employees) Retirement Benefit Rules, 1981 within a stipulated period.
In course of hearing, learned counsel for the petitioner states that the petitioner may be permitted to move a fresh representation highlighting his grievances before opposite party no.2 so that the same can be considered in the light of judgment rendered in the case of Sarat Chandra Parida v. State of Odisha, 2015 (II) ILR-CUT 94 in accordance with law.
Considering the limited nature of grievance of the petitioner, this Court directs the petitioner to file a fresh representation within a period of fifteen days from today ventilating his grievances before opposite party no.2. In the event the petitioner files such representation along with certified/authenticated copy of this order annexing the copy of the judgment in Sarat Chandra Parida (supra), opposite party no.2 shall consider and pass appropriate order in conformity with the provisions of law within a period of three months thereafter.
