This writ petition involves a challenge to the order of the revisional authority at Annexure-5 being passed under Section 23(A) of the Orissa Land Reforms Act, 1960. Backgrtound involving the case is that in the year,1950 grandfather of the present petitioner purchased the land as specified in R.S.D. No.369/1950 from the father of opposite party no.1. As a consequence of sale settlement of land records were also accordingly corrected. In the meantime, another registered sale deed namely “Nadabi Patra” was executed by the vendor in favour of the petitioner disclosing the plots under sale and the area of the land under sale involving R.S.D. No.369 of 1950. In the year, 2003, opposite party no.1 instituted a proceeding under Section 23(A) of the Orissa Land Reforms Act, 1960 before the Sub-Collector, Dharmagarh registered as Rev. Misc. Case No.61 of 2003 . The said Rev.Misc. Case being rejected, opposite party no.1 preferred appeal. Appeal was dismissed, as a consequence a revision was undertaken and in the revision, the revisional authority undertake the claim of the petitioner under section 23(A) of the Orissa Land Reforms act, 1960 declared the transfer of land is illegal thereby also given certain other direction for recovery of the land from the opposite party no.1.
