On 29.10.2015, the following order was passed:
“None appears for the appellants when the matter is called.
Fresh requisites for issuance of limitation notice on respondent No.4 shall be filed within a week failing which the appeal shall stand dismissed without further reference to the Bench as against respondent No.4.
Due to non-substitution of the legal heirs of the deceased respondent no.5, the appeal stands abated as against him.
In spite of office objections, defects are not removed. Substitution application has not been filed.
In that view of the matter, the appeal is abated and dismissed.
