23.09.2019 This writ petition has been filed assailing order dated 01.08.2001 (Annexure-3) passed by the Commissioner, Consolidation and Settlement, Bhubaneswar, i.e., opposite party No.1 in Consolidation Revision Case No.31 of 2001 dismissing the same, in the process confirming the order dated 28.02.2001 passed by the Deputy Director, Consolidation, Bhubaneswar in Appeal Case No.12 of 2001 setting aside the order dated 11.12.2000 passed by the learned Consolidation Officer, Banpur in Objection Case No.673/95/2000 filed under Section 9(3) of Orissa Consolidation of Holdings and Prevention of Fragmentation of Land Act, 1972 (for short, ‘OCH & PFL Act’), upholding the order passed by the appellate authority.

It is submitted by learned counsel for the petitioner that two revision cases were filed assailing the order passed by the Consolidation Authority in Appeal Case No.12 and 13 of 2001. Since the facts and cause of action are similar to each other those were taken up together and disposed of accordingly vide a common order under Annexure-3. Learned counsel for the petitioner submits that Revision Case No.32 of 2001 was filed assailing the order passed in Appeal Case No.13 of 2001. Against the said order, OJC No.2924 of 2002 was filed and the same stood dismissed by order dated 06.025.2018. Since both the revision cases were heard analogously and disposed of vide common judgment and OJC No.2924 of 2002 has

already been dismissed, the instant writ petition may be disposed of accordingly.

Mr.Dayananda Mohapatra, learned counsel for the opposite parties 4 to 7 has no objection to the same.

Accordingly, the writ petition is dismissed in terms of the order passed in OJC No.2924 of 2002.

Urgent certified copy of this order be granted on proper application.
