CRLMA No. 63 of 2019
The conditions no.(iii) reads as follows:“He shall appear before the I.O. on each Sunday within 10.00 A.M. to 12.00 A.M. for the purpose of investigation in this case till submission of F.F.”
And the conditions no.(vi) reads as follows:“He shall not leave the jurisdiction of this district without the prior permission of the court.”
Learned counsel for the State was asked to obtain instruction relating to the status of investigation of the case.
Today learned counsel for the State produced the letter dated 29.03.2019 of the Inspector in charge of Karanjia police station wherein it is mentioned that the investigation is under progress and the direction may be given to appear before the I.O. for the purpose of investigation as and when required.

Learned counsel for the petitioner has no objection if the condition no.(iii) is modified to that extend.
In view of the submission made at the bar, the condition no.(iii) which was imposed by the learned

S.D.J.M., Karanjia is modified to the extent that instead of appearing before the I.O. on Sunday within 10.00 a.m. to 12.00 p.m. for the purpose of investigation of the case till submission of final form, the petitioner shall appear before the I.O. as and when required for the purpose of investigation.
So far as the condition no.(vi) is concerned, in view of the progress of investigation, I am inclined to waive such condition.
Accordingly, the CRLMA is disposed of.
