There is delay of 325 days in preferring this CMAPL, as submitted by learned counsel for the petitioner.
Regard being had to the facts and submission, I am satisfied that the delay has been explained properly.
Accordingly, the delay in preferring the CMAPL is condoned, subject to payment of cost of Rs. 3250/(Rupees Three Thousand Two Hundred Fifty) to the Orissa High Court Bar Association Welfare Fund within one week from today.
The CMAPL and the I.A. are accordingly disposed of.
Taking into consideration the submission advanced by learned counsel for the petitioner, the W.P.(C) No.11506 of 2006 is restored to file.
