This is the second journey of the petitioner who is in custody in connection with Kamakhya Nagar P.S. Case No.119 of 2017 corresponding to G.R. Case No.186(A) of 2017 pending in the court of the learned S.D.J.M., Kamakhyanagar running for the alleged commission of offence under sections 395/397 IPC read with section 9(B)(1)(b) of Explosive Act and section 25 (1-B)(a)/27 of Arms Act for his release on bail.

Heard learned counsel for the petitioner and learned counsel for the State.

Considering the submissions made and on going through the materials available on record; further taking into account the factum of release of co-accused persons similarly with the petitioner on bail in BLAPL No. 2964 of 2018 and other co-accused persons in BLAPL Nos. 8853 of 2017, 1658 and 2964 of 2018 as also the surrounding circumstances including the period of detention of the petitioner in custody, while being inclined to reconsider the prayer for grant of bail to the petitioner; it is directed that the petitioner be released on bail in the aforesaid case with such terms and conditions as deemed just and proper by the court in seisin of the case with further condition that he will appear in person before the court in seisin of the case on each date of posting of the case till conclusion of the trial.

The BLAPL is accordingly disposed of.
