19.09.2019 The petitioner having been implicated in Balugaon P.S. Case No.79 of 2018 corresponding to G.R. Case No.226 of 2018 charge sheeted under sections 498-A IPC pending in the file of learned Special Court (SC & ST) Bolangir has filed this application for grant of anticipatory bail.

Learned counsel for the petitioner submits that charge sheet in the case has been submitted only for offence under section 498-A IPC placing the petitioner to trial and that too on the basis of some statements made in a general manner as to torture. In view of all the above, when there remains least scope on the part of the petitioner to flee from justice and the question of tampering the evidence does not arise, he urges for grant of anticipatory bail to the petitioner.

Learned counsel for the State opposes the move.

Considering the submissions and viewing the nature of accusations against the petitioner as well as other surrounding circumstances, it is directed that in the event petitioner surrenders before the court in seisin of the case in the aforesaid court within two weeks hence and moves for his release on bail, he shall be released on bail on such terms and conditions as would be deemed just and proper by the said court.
