Heard learned counsel for the petitioner as well as learned Additional Standing Counsel for the State-opposite party.
The offences alleged are under Secs.498(A)/302/ 304(B)/120(B)/34, I.P.C. and Sec.4 of the D.P. Act.
It is submitted on behalf of the petitioner that the petitioner is the mother-in-law of the deceased and she is inside custody since 19.4.2019. It is further submitted that the coaccused persons, namely, Debaki @Damayanti Barik and Smaranika Samadarsini @ Chumi Barik have already been released on bail by this Court in BLAPL No.6890 of 2019 and by the learned Addl. Sessions Judge, Kendrapara respectively.
The postmortem report as per the submissions made by the parties reveals that the cause of death is due to asphysix and venous constriction.
It is also submitted on behalf of the petitioner that from the statement of different witnesses it reveals that this is a case of suicide committed by the deceased.
Considering all such factors and the period of detention of the petitioner inside custody, it is directed to release the petitioner on bail in connection with Kendrapara Sadar P.S. Case No.105/2019 corresponding to S.T. Case No.215/2019 on such terms and conditions to be fixed by the learned court below in seisin over the matter.
The BLAPL is accordingly disposed of.
