Mr.Asok Mohanty, learned Senior Advocate enters appearance in Court today on behalf of the petitioner by filing appearance memo, which is taken on record.

The petitioner, being in custody in Khurdha Sadar P.S. Case No.75 of 2018 corresponding to G.R. Case No.462 of 2018 pending on the file of the learned S.D.J.M., Khurdha running for the alleged commission of offence under sections 379/34 of the IPC and section 21 of OMM(DR) Act and section 68(1) OMMC Rules, has filed this application under section 439, Cr.P.C. for his release on bail.

Heard leaned counsel for the petitioner and the learned counsel for the State.

Considering the submissions made and on going through the materials available; further keeping in view the surrounding circumstances including the period of detention of the petitioner in custody; it is directed that the petitioner be released on bail in the aforesaid case on such terms and conditions as deemed just and proper by the court in seisin of the case with further conditions that he will appear in person before the court in seisin of the case on each date of posting of the case till conclusion of the trial and will appear before the Inspectorin-Charge of the concerned police station on every Sunday in between 10.00 am to 2.00 pm for a period of eight months hence.

Violation of any of the above conditions shall entail cancellation of bail.

The BLAPL is accordingly disposed of.

Issue urgent certified copy as per rules.

A free copy of this order be handed over to the learned counsel

for the State.
