Heard learned counsel for the petitioner and the learned counsel for the State.
This is an application under section 439 Cr.P.C. in connection with C.T. Case No.1696 of 2018 arising out of Khandagiri P.S. Case No.162 of 2018 pending in the Court of learned S.D.J.M., Bhubaneswar for offences punishable under sections 302/201 of the Indian Penal Code.
The petitioner moved an application for bail before the Court of learned Sessions Judge, Khurda at Bhubaneswar which was rejected on 25.10.2018.
Learned counsel for the petitioner submitted that the petitioner is in judicial custody since 29.07.2018 and he has been charge sheeted under sections 302/201 of the Indian Penal Code. It is further contended that the occurrence in question took place on 18.04.2018 and the F.I.R. was lodged on 19.04.2018 and accordingly a case under section 307 of the Indian Penal Code was registered against unknown persons. Subsequently while the deceased Sanjaya Sahoo was undergoing treatment in the hospital, he died on 24.04.2018 whereafter the case turned to one under section 302 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that there are no eye-witnesses to the occurrence and there was civil dispute between the parties and at the instance of the petitioner, one vegetable cutter was seized in pursuance of his statement recorded under section 27 of the Evidence Act and therefore, the bail application of the petitioner may be favourably considered.
