06.03.2019 Heard learned counsel for the petitioner and the learned counsel for the State.

This is an application under section 439 Cr.P.C. in connection with G.R. Case No.890 of 2018 arising out of Koraput Sadar P.S. Case No.80 of 2018 pending in the Court of learned S.D.J.M., Koraput for offences punishable under sections 498-A/294/506/34 of the Indian Penal Code read with section 4 of the D.P. Act.

The petitioner moved an application for bail before the Court of learned Addl. Sessions Judge, Koraput which was rejected on 24.12.2018.

Considering the submission made by the learned counsel for the petitioner that the petitioner is in judicial custody since 10.09.2018 and in the meantime, after completion of investigation, charge sheet has been submitted under sections 498-A/294/506/34 of the Indian Penal Code read with section 4 of the D.P. Act against the petitioner and the offences are triable by Magistrate and after going through the 164 Cr.P.C. statement of the victim and other materials available on record produced by the learned counsel for the State, I am inclined to release the petitioner on bail.

Let the petitioner be released on bail in the aforesaid case on furnishing bail bond of Rs.20,000.00 (rupees twenty thousand) with two solvent sureties each for the like amount to the satisfaction of the Court in seisin over the matter with further terms and conditions as the learned Court may deem just and proper.

Accordingly, the BLAPL is disposed of.
